1. Introduction

RM Ayurved ("the Company") owns and operates the RM Ayurved mobile application and web platform (collectively, "the Platform"). The Platform provides access to Ayurvedic services, products, and resources for both individual users ("User Accounts") and registered vendors ("Vendor Accounts"). For the purposes of these Terms of Use, "You" refers to any person or entity accessing or using the Platform, whether as a user or vendor.

By accessing, registering, or using any part of the Platform, you agree to comply with and be bound by these Terms of Use, as may be updated from time to time. If you do not accept these Terms of Use or do not meet the requirements set forth herein, you must not use or access the Platform or avail any services or products offered by RM Ayurved.

2. Purpose of the Platform

The RM Ayurved Platform is made available for use by: (a) individuals seeking Ayurvedic health consultations, wellness services, and products through User Accounts; and (b) vendors, clinics, practitioners, and suppliers who wish to offer Ayurvedic products, services, or expertise through Vendor Accounts. Both users and vendors are collectively referred to as "Users" for the purposes of these Terms.

The Platform is designed to facilitate genuine interactions, consultations, and transactions between Users and Vendors, serving as a secure and reliable medium for exchanging information, booking appointments, purchasing products, and accessing wellness resources. All Users must have a bona fide intention to engage in legitimate Ayurvedic services, consultations, or commerce as provided by RM Ayurved. Any misuse, fraudulent activity, or unauthorized commercial use is strictly prohibited and may result in suspension or termination of access.

3. Binding Agreement

These Terms of Use constitute a binding legal agreement ("Agreement") between you and RM Ayurved ("the Company"). If you are accessing the Platform as a representative or employee of a Vendor, you represent and warrant that you are agreeing to these Terms of Use both on your own behalf and on behalf of the Vendor, and that you have the authority to bind such Vendor to this Agreement.

Your access to or use of the Platform, any part thereof, or use and/or downloading of any content available on it, indicates your acceptance of these Terms of Use and is contingent on your compliance with the Terms of Use. You agree to use the Platform of your own free will and at your own risk.

4. Eligibility
  • You are competent to enter into a valid binding contract as per Indian law.
  • You are eligible to conduct the intended Purpose lawfully, whether as a User or Vendor.
5. Use of the Platform

The RM Ayurved Platform, encompassing all its features, services, and products—whether complimentary or paid—is strictly intended for genuine, ethical, and lawful activities that align with the objectives and spirit of these Terms. RM Ayurved reserves the exclusive right to determine whether any specific action, behavior, or use is permitted or falls outside the intended scope. Any use of the Platform that deviates from these guidelines may result in immediate suspension or termination of access, and may also lead to legal action, including claims for damages or injunctive relief.

The Platform is designed to facilitate meaningful interactions, consultations, and transactions between Users and Vendors, serving as a secure and reliable medium for exchanging information, booking appointments, purchasing products, and accessing wellness resources. All Users must have a bona fide intention to engage in legitimate Ayurvedic services, consultations, or commerce as provided by RM Ayurved. Any misuse, fraudulent activity, or unauthorized commercial use is strictly prohibited and may result in suspension or termination of access.

The following activities are strictly prohibited and will be considered misuse of the Platform:

  • Replicating, copying, downloading, distributing, altering, selling, storing, or creating derivative works from any content, data, information, user profiles, images, or graphics found on the Platform, or any RM Ayurved services or products, for purposes that do not comply with these Terms or extend beyond the intended use.
  • Using the Platform or its data for unauthorized commercial purposes, such as building alternative databases, providing access to third parties without RM Ayurved ’s written consent, or engaging in activities that compete with RM Ayurved ’s business interests.
  • Reselling RM Ayurved ’s products or services, or seeking any form of compensation or fees without prior written authorization from RM Ayurved.
  • Deploying automated programs, bots, scripts, crawlers, or similar technologies to access, monitor, copy, download, scrape, or extract data or content from the Platform in any manner.
  • Attempting to gain unauthorized access to any section of the Platform, RM Ayurved ’s systems, or other users ’ accounts, including but not limited to hacking, password mining, or other illicit methods.
  • Modifying, overlaying, or simulating the Platform ’s services or appearance using any technology, or accessing the Platform through interfaces not expressly provided by RM Ayurved.
  • Bypassing or attempting to bypass any security measures, service limits, or authentication protocols established by RM Ayurved.
  • Extracting, replicating, or bulk-downloading information to offer products or services that compete with RM Ayurved, or for any unauthorized commercial use.
  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Platform or any related technology.
  • Impersonating any individual or entity, misrepresenting affiliations, or forging identifiers to conceal the origin of communications or data.
  • Harassing, stalking, threatening, or otherwise interfering with the experience or safety of other users on the Platform.
  • Uploading, posting, or transmitting any material that is illegal, harmful, offensive, infringing, or contains viruses, malware, or other malicious code.
  • Engaging in spamming, sending unsolicited communications, or using user contact details for marketing or promotional purposes unrelated to RM Ayurved ’s services.
  • Hosting, publishing, or distributing content that violates any law, infringes third-party rights, or is abusive, defamatory, obscene, or otherwise objectionable.
  • Participating in any activity that threatens the security, integrity, or sovereignty of India, or violates public order or applicable laws.
  • Attempting to interfere with, disrupt, or overload the Platform ’s infrastructure, including by using devices, software, or routines that may harm the Platform ’s performance or accessibility for other users.
  • Engaging in framing, mirroring, or simulating the appearance or function of the Platform, or providing deep links to any part of the Platform without prior written permission from RM Ayurved.
  • Using the Platform or user contact details for transmitting marketing, promotional, or offensive messages, or for sending unsolicited commercial communications unrelated to RM Ayurved ’s services.
  • Hosting, uploading, or distributing any material or information that violates applicable local, state, national, or international law, infringes the rights of RM Ayurved or any third party, or contains harmful, abusive, defamatory, obscene, or otherwise unlawful content.
  • Introducing or attempting to introduce viruses, malware, or any other harmful code or programs designed to disrupt, destroy, or interfere with the functioning of the Platform or any other computer system or resource.
  • Engaging in any conduct that is grossly harmful, harassing, invasive of another's privacy, hateful, disparaging, or otherwise objectionable, including content that encourages money laundering, gambling, or any criminal activity.
  • Deceiving or misleading other users about the origin of messages, or communicating information that is grossly offensive or menacing in nature.
  • Threatening the unity, integrity, defense, security, or sovereignty of India, or public order, or causing incitement to the commission of any cognizable offense, or preventing investigation of any offense, or insulting any other nation.

RM Ayurved may introduce additional requirements or restrictions depending on the nature of the services or the type of account. By using the Platform, you agree to receive necessary communications from RM Ayurved, including administrative notifications and transactional messages. Any breach of these terms may result in account suspension, termination, or further legal consequences as deemed appropriate by RM Ayurved.

In addition to the above, RM Ayurved reserves the right to monitor all activities on the Platform to ensure compliance with these Terms and to protect the interests of users, vendors, and the Company. RM Ayurved may investigate any suspected violations and cooperate with law enforcement authorities or third parties in such investigations. The Company may also remove, edit, or block any content or user accounts that are found to be in violation of these Terms, without prior notice and at its sole discretion.

Users and Vendors are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their accounts. Sharing account access or credentials with unauthorized persons is strictly prohibited and may result in immediate termination of access. RM Ayurved will not be liable for any loss or damage arising from unauthorized use of your account.

The Platform may contain links to third-party websites or services. RM Ayurved does not endorse or assume responsibility for any third-party content, products, or services. Accessing third-party links is at your own risk, and you should review the terms and privacy policies of those sites before engaging with them.

RM Ayurved strives to maintain the security and integrity of the Platform, but cannot guarantee that the Platform will always be free from errors, interruptions, or unauthorized access. Users are encouraged to report any suspicious activity, security breaches, or violations of these Terms to RM Ayurved immediately.

By using the Platform, you acknowledge and agree that RM Ayurved may update, modify, or discontinue any aspect of the Platform, its services, or these Terms at any time, without prior notice. Continued use of the Platform after any changes constitutes acceptance of the revised Terms.

6. Notice Regarding Platform Services and Enforcement

RM Ayurved, through its Platform, does not act as an agent, intermediary, or labor consultant for any user, vendor, or subscriber. The Company does not appoint representatives or operate via agents for any purpose related to the Platform’s services, products, or user interactions. All engagements, transactions, and communications must be conducted directly through the official RM Ayurved Platform and not through any third party claiming to represent RM Ayurved.

If any misuse, abuse, or violation of the Platform’s rules is detected, RM Ayurved reserves the right to take any action it considers appropriate, including but not limited to:

  • Immediate suspension or termination of your access to the Platform, its products, or services, without prior notice.
  • Removal or disabling of any content that does not comply with these Terms of Use.
  • Reporting the incident or misuse to relevant authorities, regulatory bodies, or law enforcement agencies.
  • Initiating legal proceedings or claims as deemed necessary.

Should any misuse result in, or have the potential to result in, financial loss, reputational harm, or depletion of RM Ayurved’s user base, the Company further reserves the right to seek appropriate remedies, including but not limited to monetary damages, injunctive relief, or other legal recourse.

Users are advised to interact only through the official RM Ayurved app or web platform and to report any suspicious activity, unauthorized agent claims, or violations of these Terms to RM Ayurved’s support team immediately.

7. Limitations on Use

You agree to comply with any restrictions or limitations imposed by RM Ayurved regarding the use of the Platform, including but not limited to geographic access, number of transactions, or quantity of data accessed or downloaded. Any violation of these limitations may result in suspension or termination of your account and services, and RM Ayurved reserves the right to take any action it deems appropriate.

8. Accuracy and Correctness of User Information

When registering or creating a profile on the RM Ayurved Platform, you undertake to provide only accurate and truthful information, and to keep your details updated at all times. Impersonation or misrepresentation is strictly prohibited. RM Ayurved reserves the right to remove or suspend any content or profile that violates these Terms, including those containing false, incomplete, or outdated information. Failure to maintain accurate contact details may result in termination of access.

9. Security of Login Credentials

You are responsible for safeguarding your account credentials and must not share your password or login details with anyone. All activities conducted under your account are your responsibility. RM Ayurved will take reasonable measures to protect your credentials, but you must notify us immediately of any unauthorized use or security breach.

10. Links to Third-Party Sites

The Platform may provide links to external websites or services for your convenience. RM Ayurved does not endorse or control the content of these third-party sites and is not responsible for their practices or policies. Accessing such sites is at your own risk, and you should review their terms and privacy policies before engaging with them.

11. Disclaimers

RM Ayurved acts as a digital intermediary, providing a platform for users and vendors to interact, share information, and access Ayurvedic services and products. The Company is not responsible for content posted by users or third parties. All information and services are provided "as is" without warranties of any kind, express or implied. RM Ayurved does not guarantee the accuracy, reliability, or completeness of any content or the effectiveness of any service or product offered. Users are encouraged to report any inappropriate or inaccurate content to RM Ayurved for review and possible removal.

12. Make Your Own Decision

Any reliance on information, content, or communications on the Platform is at your own risk. Users should conduct independent checks before proceeding with any transaction or consultation. RM Ayurved does not guarantee the authenticity or outcome of any interaction or service, and all decisions made are your sole responsibility.

13. Limitation of Liability

To the maximum extent permitted by law, RM Ayurved shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, revenue, goodwill, data, or other intangible losses. RM Ayurved does not guarantee uninterrupted service or server uptime. In no event will RM Ayurved’s aggregate liability exceed the amount of fees paid by you for services. These limitations apply regardless of the nature of the claim.

14. Privacy

Please use the privacy settings available on the Platform to protect your information. RM Ayurved’s Privacy Policy explains how your personal data is used. You are responsible for controlling how your information is displayed and shared. Any feedback provided by users is considered non-confidential. When you share or upload information, others may be able to view, copy, or download it.

15. Payment Terms & Refund Policy

Payments for RM Ayurved services are to be made in advance and are generally non-refundable. Refunds, if any, are at the sole discretion of RM Ayurved. Users making payments online may be redirected to third-party gateways, and RM Ayurved is not responsible for any issues arising from such transactions. Any suspension or termination due to non-compliance will result in forfeiture of payments made. RM Ayurved is not liable for any loss or damage due to disclosure of account or payment information.

16. Amendment to Terms

RM Ayurved reserves the right to modify, update, or change these Terms at any time without prior notice. Changes will be posted on the Platform and are effective immediately. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Users are advised to review the Terms periodically.

17. Intellectual Property Rights

All rights, title, and interest in the Platform, including intellectual property rights, trademarks, logos, and content, are owned by RM Ayurved. You are granted a limited, revocable license to use the Platform for its intended purpose. Any misuse or unauthorized use of RM Ayurved’s intellectual property is strictly prohibited and may result in legal action.

18. Local Laws

You are responsible for complying with all applicable local laws and regulations while using the Platform and its services, including any export or import restrictions.

19. Indemnification

By accepting these Terms, you agree to indemnify and hold harmless RM Ayurved, its directors, officers, employees, agents, and affiliates from any claims, damages, or liabilities arising out of your use of the Platform or any violation of these Terms.

20. Taxes

All applicable taxes, including GST or VAT, will be charged in accordance with local laws. You are responsible for providing accurate tax information and for any consequences arising from incorrect or incomplete data.

21. Termination and Suspension

RM Ayurved may, at its sole discretion and without notice, terminate or restrict your access to the Platform for any reason, including violation of these Terms. Upon termination, any limited rights granted to you revert to RM Ayurved, and you must return any unused data or information. Misuse of data after termination is actionable.

22. Dispute Settlement

Any disputes arising out of the use of the Platform shall be resolved through arbitration in accordance with Indian law. The venue for arbitration shall be Agra, India, and the decision of the arbitrator shall be final and binding.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Agra, India.

24. Entire Agreement

These Terms constitute the entire agreement between you and RM Ayurved regarding the Platform and supersede any prior agreements or understandings.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

26. Assignment and Delegation

You may not assign or delegate your rights under these Terms. Any attempt to do so will be void and may result in legal action.

27. Availability of Services

Services are provided on an "as is" and "as available" basis. RM Ayurved does not guarantee uninterrupted access or server uptime. Regulatory changes or force majeure events may affect service availability.

28. Activation

For security reasons, services purchased online may require verification before activation. RM Ayurved reserves the right to delay or deny activation in case of suspected fraud.
